Terms of service
OVERVIEW
Welcome to Nura Renüa! The terms "we", "us" and "our" refer to Nura Renüa. Nura Renüa operates this store and website, including all related information, content, features, tools, products and services in order to provide you, the customer, with a curated shopping experience (the "Services"). Nura Renüa is powered by Shopify, which enables us to provide the Services to you.
The below terms and conditions, together with any policies referenced herein (these "Terms of Service" or "Terms") describe your rights and responsibilities when you use the Services.
Please read these Terms of Service carefully, as they include important information about your legal rights and cover areas such as warranty disclaimers and limitations of liability.
By visiting, interacting with or using our Services, you agree to be bound by these Terms of Service and our Privacy Policy. If you do not agree to these Terms of Service or Privacy Policy, you should not use or access our Services.
SECTION 1 - ACCESS AND ACCOUNT
By agreeing to these Terms of Service, you represent that you are at least the age of majority in your state or province of residence, and you have given us your consent to allow any of your minor dependents to use the Services on devices you own, purchase or manage.
To use the Services, including accessing or browsing our online stores or purchasing any of the products or services we offer, you may be asked to provide certain information, such as your email address, billing, payment, and shipping information. You represent and warrant that all the information you provide in our stores is correct, current and complete and that you have all rights necessary to provide this information.
You are solely responsible for maintaining the security of your account credentials and for all of your account activity. You may not transfer, sell, assign, or license your account to any other person.
SECTION 2 - OUR PRODUCTS
We have made every effort to provide an accurate representation of our products and services in our online stores. However, please note that colors or product appearance may differ from how they may appear on your screen due to the type of device you use to access the store and your device settings and configuration.
We do not warrant that the appearance or quality of any products or services purchased by you will meet your expectations or be the same as depicted or rendered in our online stores.
All descriptions of products are subject to change at any time without notice at our sole discretion. We reserve the right to discontinue any product at any time and may limit the quantities of any products that we offer to any person, geographic region or jurisdiction, on a case-by-case basis.
Because many of our products are handcrafted in small batches using fresh and seasonal ingredients, slight variations in flavor, color, texture, garnish, presentation, packaging, and appearance are natural and should not be considered defects. Product photographs are intended to represent the general appearance of our products but may not reflect every individual item exactly.
SECTION 2A – FOOD SAFETY & ALLERGENS
Nura Renüa prepares its food and beverages in a licensed commercial kitchen in accordance with applicable health and food safety regulations.
While we strive to handle ingredients with care, our products are prepared in an environment where coconut, milk, eggs, wheat, soy, tree nuts, peanuts, and other allergens may be present. As a result, we cannot guarantee that any product is completely free from allergens or cross-contact.
It is the customer's responsibility to inform us of any food allergies, sensitivities, or dietary restrictions before placing an order or consuming any of our products. We are not responsible for allergic reactions or adverse health effects resulting from undeclared allergies, food sensitivities, or individual dietary needs.
Product descriptions, ingredient lists, nutritional information, and allergen information provided on our website, menus, social media platforms, or marketing materials are intended for general informational purposes only and should not be interpreted as medical or nutritional advice. Customers with severe allergies or medical conditions should consult an appropriate healthcare professional before consuming our products.
Because our products are handcrafted in small batches, ingredients, garnishes, colors, textures, and presentation may vary slightly from photographs, promotional materials, or previous purchases without affecting the overall quality of the product.
SECTION 3 - ORDERS
When you place an order, you are making an offer to purchase. Nura Renüa reserves the right to accept or decline your order for any reason at its sole discretion. Your order is not accepted until Nura Renüa confirms its acceptance. We must receive and successfully process your payment before your order is accepted.
Please review your order carefully before submitting it, as we may be unable to accommodate cancellation or modification requests once an order has been accepted or production has begun. In the event that we do not accept, modify, or cancel an order, we will make reasonable efforts to notify you using the email address, billing address, and/or telephone number provided at the time the order was placed.
Your purchases are subject to our Refund Policy, which is incorporated into these Terms by reference.
You represent and warrant that your purchases are for your personal, household, or authorized business use and not for unauthorized commercial resale, redistribution, or export.
Because many of our products are handcrafted, prepared fresh, or produced in limited quantities, certain products may be available only through advance order, specific markets, private events, seasonal offerings, or limited-time releases. Product availability is not guaranteed until your order has been accepted and confirmed by Nura Renüa.
Custom orders, catering services, private events, corporate events, collaborations, seasonal products, limited-edition items, and personalized products may be subject to additional production timelines, deposits, payment schedules, cancellation policies, guest count deadlines, or other terms communicated during the ordering process or set forth in a separate written agreement. In the event of any conflict between these Terms and a separately executed event or catering agreement, the terms of the written event or catering agreement shall control solely with respect to that service.
Nura Renüa reserves the right to refuse, limit, or cancel any order where we reasonably believe the order involves fraud, unauthorized resale, pricing errors, inventory shortages, payment issues, misuse of promotional offers, or any violation of these Terms of Service.
SECTION 3A – CATERING & EVENT SERVICES
The following terms apply to all catering services, private events, pop-up activations, beverage bars, dessert bars, corporate events, brand collaborations, and any other event services provided by Nura Renüa.
Unless otherwise agreed in writing, a non-refundable deposit of fifty percent (50%) of the event total is required to reserve an event date, and the remaining balance is due seven (7) days before the event; events booked less than seven (7) days in advance are paid in full. If you cancel more than seven (7) days before your event, your deposit may be applied once to a new date within six (6) months. Cancellations within seven (7) days of the event are not refundable. If Nura Renüa must cancel, you will receive a full refund of amounts paid. An event is not considered confirmed until the required deposit has been received.
The remaining balance must be paid by the date specified in your invoice, proposal, or event agreement. Failure to make payment by the required date may result in cancellation of the event without liability to Nura Renüa.
Final guest counts, menu selections, dietary accommodations, and event details must be confirmed by the deadline established by Nura Renüa. Changes requested after this deadline may not be accommodated and may result in additional charges.
The client is responsible for ensuring that Nura Renüa has safe and reasonable access to the event location, including any required parking, loading areas, electrical access (when applicable), permits, venue approvals, and any other conditions necessary to provide the agreed services.
Event start and end times are based on the agreement between the client and Nura Renüa. Delays caused by the client, venue, guests, or third parties do not extend the contracted service period unless otherwise approved by Nura Renüa and may be subject to additional fees.
Weather conditions, venue restrictions, government regulations, public safety concerns, acts of nature, or circumstances beyond our reasonable control may require modifications, delays, or cancellation of services. In such situations, Nura Renüa will make reasonable efforts to reschedule or provide an appropriate solution, but shall not be liable for circumstances outside its control.
Because our products are handcrafted and prepared in small batches, menu items, garnishes, presentation, and availability may vary due to seasonal ingredients, supplier availability, or operational requirements while maintaining comparable quality whenever reasonably possible.
Unless otherwise agreed in writing, all equipment, serving items, display materials, décor, and branded items supplied by Nura Renüa remain the property of Nura Renüa and must be returned in substantially the same condition in which they were provided. The client may be responsible for repair or replacement costs resulting from loss, theft, or damage beyond ordinary wear and tear.
SECTION 3B – THE RITUAL TAP WALL
The Ritual Tap Wall is rented for the date, time and location in your confirmed proposal, either as a drop-off rental or as a hosted rental staffed by our team. When the host chooses to serve beer, wine, sparkling or any other alcoholic beverage, the host provides those beverages and is solely responsible for serving them legally and responsibly, including any required permits or licenses, checking identification, preventing service to minors or visibly intoxicated guests, and complying with venue rules and applicable law. Nura Renüa does not sell or provide alcoholic beverages. During a drop-off rental, the host is responsible for the equipment from delivery until pickup and may be charged for repair or replacement of equipment that is lost, stolen or damaged beyond ordinary wear and tear.
SECTION 3C – GIFT CARDS
Nura Renüa gift cards are available in the amounts shown at checkout. Gift cards can be redeemed online at nurarenua.com and at our markets and pop-ups, and they do not expire. Gift cards cannot be redeemed for cash except where required by law, cannot be reloaded, and cannot be used to purchase other gift cards. Please treat your gift card code like cash; we are not responsible for lost or stolen codes or for use by anyone who has your code.
SECTION 3D – THE RITUAL SOCIETY & RITUAL REWARDS
The Ritual Society is a free membership program. You may join with your email address, and joining includes consent to receive Ritual Society emails, which you may unsubscribe from at any time. Member-only benefits, such as Hidden Rituals, First Taste and member experiences, are available to members with at least one order in the previous six (6) months, and are offered while supplies last and subject to availability. Ritual Rewards: members earn one (1) Ritual per completed order, regardless of order amount, online or at our markets and pop-ups when the order is linked to the member's email or phone number. Ten (10) Rituals may be redeemed for one drink, up to a value of $10; if the selected drink costs more, the member pays the difference. Rituals are earned only through purchases, have no cash value, cannot be transferred, sold or combined between accounts, and expire after six (6) months without an order. Refunded or canceled orders do not earn Rituals, and Rituals earned on them may be removed. Gift card purchases do not earn Rituals. We may modify, pause or end The Ritual Society or Ritual Rewards, or change their benefits, at any time with reasonable notice, and we may remove members or Rituals in cases of fraud, abuse or violation of these Terms.
SECTION 3E – COLLABORATIONS & APPLICATIONS
Applications submitted through our Influencer Collab page or any other collaboration form do not create any agreement or obligation. Any collaboration, gifted product, affiliate commission or paid partnership is subject to separate terms agreed in writing. Please do not send links, files or confidential materials through our forms.
SECTION 4 - PRICES AND BILLING
Prices, discounts, and promotions are subject to change without notice. The price charged for a product or service will be the price in effect at the time the order is placed and will be set out in your order confirmation email. Unless otherwise expressly stated, posted prices do not include applicable taxes, shipping, handling, delivery, customs, import charges, gratuities, or other applicable fees.
Prices posted in our online store may differ from prices offered at farmers markets, festivals, pop-up events, catering services, private events, collaborations, retail partners, or other sales channels. Pricing may vary based on product availability, location, event-specific offerings, operating costs, seasonal ingredients, promotional campaigns, or other business considerations.
We may offer promotions, discounts, bundles, limited-time offers, or promotional pricing that are governed by separate terms and conditions. In the event of any conflict between the terms applicable to a promotion and these Terms of Service, the promotional terms shall govern solely with respect to that promotion.
You agree to provide current, complete, and accurate purchase, payment, and account information for all purchases made through our Services. You agree to promptly update your account and other information, including your email address, payment information, billing address, and any other relevant information so that we may complete your transactions and contact you as necessary.
You represent and warrant that (i) the payment information you provide is true, accurate, and complete; (ii) you are authorized to use the selected payment method; (iii) charges incurred by you will be honored by your financial institution or payment provider; and (iv) you will pay all charges incurred at the prices in effect at the time of purchase, including applicable taxes, delivery charges, service fees, and any other applicable charges.
Certain services, including catering, private events, custom orders, corporate events, workshops, collaborations, and other special services, may require deposits, milestone payments, or full payment in advance. Unless otherwise agreed in writing, deposits are non-refundable except where required by applicable law or expressly provided in a separate written agreement.
In the event of an obvious pricing error, typographical error, system malfunction, or technical issue affecting the price of a product or service, Nura Renüa reserves the right to cancel or refuse the affected order and issue a full refund of any amount paid, even if the order has already been submitted or payment has been authorized.
SECTION 5 - SHIPPING AND DELIVERY
We are not liable for shipping or delivery delays. All delivery times are estimates only and are not guaranteed. We are not responsible for delays caused by shipping carriers, customs processing, weather conditions, traffic, venue restrictions, governmental actions, or other events beyond our reasonable control.
Once products are delivered to the shipping carrier, title to and risk of loss for shipped products passes to you, unless otherwise required by applicable law.
Certain Nura Renüa products are perishable and require proper refrigeration, handling, and timely consumption. Customers are responsible for properly storing, transporting, and handling perishable food and beverage products immediately upon delivery, pickup, or purchase at a farmers market, festival, pop-up event, or other sales location. Nura Renüa is not responsible for any loss of quality, freshness, spoilage, or food safety issues resulting from improper storage, transportation, delayed consumption, or failure to follow any storage or serving instructions after the products have been received by the customer.
Certain products, including coquito, refrigerated beverages, desserts, and other temperature-sensitive items, should remain refrigerated until ready to serve unless otherwise instructed. Failure to properly refrigerate these products may affect their quality and safety, and Nura Renüa shall not be responsible for damages resulting from improper handling after delivery or pickup.
Customers choosing local pickup are responsible for collecting their orders within the agreed pickup window. Orders not collected within a reasonable time may be subject to quality limitations, disposal, or additional charges where permitted by applicable law.
Products purchased at farmers markets, festivals, pop-up events, or other temporary sales locations are deemed accepted by the customer at the time of purchase unless any issue is reported to a Nura Renüa team member before leaving our service area.
SECTION 5A – PICKUP, FARMERS MARKETS & PERISHABLE PRODUCTS
Certain Nura Renüa products are perishable and require proper handling, refrigeration, and timely consumption. Upon delivery, pickup, or purchase at a farmers market, pop-up event, or other location, responsibility for the proper storage, handling, and consumption of the products transfers to the customer.
Customers are responsible for following any storage or serving instructions provided by Nura Renüa. We are not responsible for product quality, freshness, or food safety issues resulting from improper storage, transportation, delayed consumption, or failure to follow recommended handling instructions after the product has been received.
Product availability may vary by location, event, season, or production capacity. Certain menu items may only be available at select markets, events, or through advance order. We reserve the right to substitute ingredients, modify garnishes, or discontinue products without prior notice when necessary due to seasonal availability, supplier limitations, or operational needs.
Because our products are handcrafted in small batches, slight variations in appearance, color, texture, garnish, or presentation are normal and do not constitute defects or grounds for refunds.
Products purchased at farmers markets, pop-up events, festivals, or other temporary locations are considered accepted by the customer upon completion of the transaction unless a concern is brought to our attention before leaving our service area.
Unless otherwise required by applicable law, perishable food and beverage products are generally not eligible for returns or exchanges once they have been delivered or accepted by the customer.
SECTION 6 - INTELLECTUAL PROPERTY
Our Services, including but not limited to all trademarks, brands, text, displays, images, graphics, product reviews, video, and audio, and the design, selection, and arrangement thereof, are owned by Nura Renüa, its affiliates or licensors and are protected by U.S. and foreign patent, copyright and other intellectual property laws.
These Terms permit you to use the Services for your personal, non-commercial use only. You must not reproduce, distribute, modify, create derivative works of, publicly display, publicly perform, republish, download, store, or transmit any of the material on the Services without our prior written consent. Except as expressly provided herein, nothing in these Terms grants or shall be construed as granting a license or other rights to you under any patent, trademark, copyright, or other intellectual property of Nura Renüa, Shopify or any third party. Unauthorized use of the Services may be a violation of federal and state intellectual property laws. All rights not expressly granted herein are reserved by Nura Renüa.
Nura Renüa's names, logos, product and service names, designs, and slogans are trademarks of Nura Renüa or its affiliates or licensors. You must not use such trademarks without the prior written permission of Nura Renüa. Shopify's name, logo, product and service names, designs and slogans are trademarks of Shopify. All other names, logos, product and service names, designs, and slogans on the Services are the trademarks of their respective owners.
SECTION 6A – BRAND ASSETS, RECIPES & CONTENT OWNERSHIP
In addition to the intellectual property protections described above, all original branding, logos, slogans, website content, photographs, videos, graphics, illustrations, product photography, menu designs, product descriptions, marketing materials, event concepts, proprietary recipes maintained as trade secrets, packaging designs, and other original creative works created, published, or used by Nura Renüa are and shall remain the exclusive property of Nura Renüa unless otherwise expressly stated in writing.
This includes, without limitation, the Nura Renüa name, The Coconut Ritual, A Taste of the Caribbean, The Ritual Deck, and any original product names, collections, campaigns, event concepts, slogans, or branding elements developed by Nura Renüa, including future products, services, or marketing initiatives.
Nothing contained in these Terms shall be interpreted as claiming exclusive ownership over generic, descriptive, or third-party terms that may also be used within the food and beverage industry. Any trademarks, service marks, product names, or intellectual property owned by third parties remain the property of their respective owners.
Customers, competitors, businesses, content creators, and third parties may not reproduce, copy, imitate, modify, republish, distribute, publicly display, publicly perform, transmit, sell, license, exploit, or create derivative works based upon Nura Renüa's original branding, creative works, photographs, videos, menus, website content, product descriptions, event concepts, marketing materials, or any other proprietary content without the prior written consent of Nura Renüa.
The purchase of any product or service from Nura Renüa does not grant any ownership interest or license in any of our intellectual property, trade dress, copyrights, trademarks, trade secrets, proprietary recipes, branding, creative works, or other protected materials.
Unauthorized use, reproduction, imitation, distribution, or commercial exploitation of Nura Renüa's intellectual property or proprietary content may result in legal action to the fullest extent permitted under applicable federal, state, and international intellectual property, copyright, trademark, trade secret, and unfair competition laws.
SECTION 7 - OPTIONAL TOOLS
You may be provided with access to customer tools offered by third parties as part of the Services, which we neither monitor nor have any control nor input.
You acknowledge and agree that we provide access to such tools "as is" and "as available" without any warranties, representations or conditions of any kind and without any endorsement. We shall have no liability whatsoever arising from or relating to your use of optional third-party tools.
Any use by you of the optional tools offered through the site is entirely at your own risk and discretion and you should ensure that you are familiar with and approve of the terms on which tools are provided by the relevant third-party provider(s).
We may also, in the future, offer new features through the Services (including the release of new tools and resources). Such new features shall also be deemed part of the Services and are subject to these Terms of Service.
SECTION 8 - THIRD-PARTY LINKS
The Services may contain materials and hyperlinks to websites provided or operated by third parties (including any embedded third party functionality). We are not responsible for examining or evaluating the content or accuracy of any third-party materials or websites you choose to access. If you decide to leave the Services to access these materials or third party sites, you do so at your own risk.
We are not liable for any harm or damages related to your access of any third-party websites, or your purchase or use of any products, services, resources, or content on any third-party websites. Please review carefully the third-party's policies and practices and make sure you understand them before you engage in any transaction. Complaints, claims, concerns, or questions regarding third-party products and services should be directed to the third-party.
SECTION 8A – OFFICIAL COMMUNICATION CHANNELS & SOCIAL MEDIA
Nura Renüa communicates with customers through its official website, email, and authorized social media platforms, including but not limited to Instagram, Facebook, TikTok, Pinterest, Threads, YouTube, WhatsApp Business, and any future digital platforms operated by Nura Renüa (collectively, the "Official Channels").
Information published through our Official Channels, including product announcements, menu updates, event schedules, promotions, policies, operating hours, educational content, and other business communications, is intended for informational purposes only and may be updated, modified, or removed at any time without prior notice.
Communications conducted through our Official Channels, including direct messages, comments, emails, or other digital communications, do not constitute a legally binding agreement unless expressly confirmed in writing by an authorized representative of Nura Renüa.
We reserve the right to moderate, remove, restrict, or report comments, reviews, messages, or other user-generated content that we reasonably determine to be unlawful, abusive, threatening, discriminatory, defamatory, misleading, fraudulent, obscene, spam, infringing upon intellectual property rights, or otherwise inconsistent with our community standards or applicable law.
Customers should only rely on information published through our Official Channels. Nura Renüa is not responsible for inaccurate information distributed through unofficial accounts, unauthorized third parties, or individuals falsely representing our business.
SECTION 9 - RELATIONSHIP WITH SHOPIFY
[NOTE TO MERCHANT: This section accurately characterizes Shopify's relationship with your store and should not be removed or modified.]
Nura Renüa is powered by Shopify, which enables us to provide the Services to you. However, any sales and purchases you make in our Store are made directly with Nura Renüa. By using the Services, you acknowledge and agree that Shopify is not responsible for any aspect of any sales between you and Nura Renüa, including any injury, damage, or loss resulting from purchased products and services. You hereby expressly release Shopify and its affiliates from all claims, damages, and liabilities arising from or related to your purchases and transactions with Nura Renüa.
SECTION 10 - PRIVACY POLICY
All personal information we collect through the Services is subject to our Privacy Policy, which can be viewed here, and certain personal information may be subject to Shopify's Privacy Policy, which can be viewed here. By using the Services, you acknowledge that you have read these privacy policies.
Because the Services are hosted by Shopify, Shopify collects and processes personal information about your access to and use of the Services in order to provide and improve the Services for you. Information you submit to the Services will be transmitted to and shared with Shopify as well as third parties that may be located in other countries than where you reside, in order to provide services to you. Review our Privacy Policy for more details on how we, Shopify, and our partners use your personal information.
SECTION 11 - FEEDBACK
If you submit, upload, post, email, or otherwise transmit any ideas, suggestions, feedback, reviews, proposals, plans, or other content (collectively, "Feedback"), you grant us a perpetual, worldwide, sublicensable, royalty-free license to use, reproduce, modify, publish, distribute and display such Feedback in any medium for any purpose, including for commercial use. We may, for example, use our rights under this license to operate, provide, evaluate, enhance, improve and promote the Services and to perform our obligations and exercise our rights under the Terms of Service.
You also represent and warrant that: (i) you own or have all necessary rights to all Feedback; (ii) you have disclosed any compensation or incentives received in connection with your submission of Feedback; and (iii) your Feedback will comply with these Terms. We are and shall be under no obligation (1) to maintain your Feedback in confidence; (2) to pay compensation for your Feedback; or (3) to respond to your Feedback.
We may, but have no obligation to, monitor, edit or remove Feedback that we determine in our sole discretion to be unlawful, offensive, threatening, libelous, defamatory, pornographic, obscene or otherwise objectionable or violates any party's intellectual property or these Terms of Service.
You agree that your Feedback will not violate any right of any third-party, including copyright, trademark, privacy, personality or other personal or proprietary right. You further agree that your Feedback will not contain libelous or otherwise unlawful, abusive or obscene Feedback, or contain any computer virus or other malware that could in any way affect the operation of the Services or any related website. You may not use a false email address, pretend to be someone other than yourself, or otherwise mislead us or third-parties as to the origin of any Feedback. You are solely responsible for any Feedback you make and its accuracy. We take no responsibility and assume no liability for any Feedback posted by you or any third-party.
SECTION 11A – PHOTOGRAPHY, VIDEO & MEDIA RELEASE
Nura Renüa may photograph, record, or otherwise capture images, audio, or video during public markets, pop-up events, festivals, catering services, private events, brand collaborations, community events, and other activities related to our business for promotional, educational, marketing, advertising, and archival purposes.
By voluntarily posing for, participating in, or otherwise allowing photographs or video recordings to be taken by Nura Renüa during public events or activities, you grant Nura Renüa a non-exclusive, worldwide, royalty-free, perpetual license to use, reproduce, publish, display, distribute, edit, and otherwise use your likeness, image, voice, and appearance in connection with our business, including but not limited to our website, social media platforms, digital advertising, printed materials, email marketing, promotional campaigns, press materials, and future marketing initiatives, without additional compensation.
For private events, catering services, or other contracted services, the client may notify Nura Renüa in writing before the event if they do not wish photographs or video recordings to be taken for promotional purposes. We will make commercially reasonable efforts to accommodate such requests.
Nura Renüa will not knowingly use identifiable images of minors for promotional purposes without the consent of a parent or legal guardian, except where otherwise permitted by applicable law.
Customers who prefer not to appear in photographs or videos during public events should notify a member of the Nura Renüa team before or during their visit. While we will make reasonable efforts to accommodate such requests, we cannot guarantee that individuals will not appear incidentally in photographs or recordings captured in public spaces.
Nothing in this Section grants any customer ownership of photographs, videos, or other media created by Nura Renüa. All such content shall remain the exclusive property of Nura Renüa and may be used in accordance with these Terms.
SECTION 12 - ERRORS, INACCURACIES AND OMISSIONS
Occasionally there may be information on or in the Services that contain typographical errors, inaccuracies or omissions that may relate to product descriptions, pricing, promotions, offers, product shipping charges, transit times and availability. We reserve the right to correct any errors, inaccuracies or omissions, and to change or update information or cancel orders if any information is inaccurate at any time without prior notice (including after you have submitted your order).
SECTION 12A – PRODUCT AVAILABILITY, MENU CHANGES & SEASONAL ITEMS
Because Nura Renüa specializes in handcrafted food and beverages prepared in small batches, product availability may vary based on seasonal ingredients, supplier availability, production capacity, weather conditions, farmers market schedules, special events, and other operational factors.
We reserve the right to modify, substitute, discontinue, rename, or temporarily remove any product, ingredient, garnish, recipe, packaging, presentation, or menu item at any time without prior notice.
Product photographs, promotional images, advertisements, website content, social media content, and other marketing materials are intended to represent the general appearance and style of our products. Because each item is handcrafted, slight differences in color, texture, garnish, presentation, packaging, or appearance are normal and do not constitute defects or misrepresentation.
Seasonal products, limited-edition items, promotional offerings, collaborations, and event-exclusive menu items are available only while supplies last and may not be available at all locations, events, or times.
Nura Renüa reserves the right to limit quantities purchased, refuse bulk purchases when necessary, or substitute comparable ingredients when circumstances reasonably require, provided that such substitutions do not materially alter the nature or quality of the product.
SECTION 13 - PROHIBITED USES
You may access and use the Services for lawful purposes only. You may not access or use the Services, directly or indirectly: (a) for any unlawful or malicious purpose; (b) to violate any international, federal, provincial or state regulations, rules, laws, or local ordinances; (c) to infringe upon or violate our intellectual property rights or the intellectual property rights of others; (d) to harass, abuse, insult, harm, defame, slander, disparage, intimidate, or harm any of our employees or any other person; (e) to transmit false or misleading information; (f) to send, knowingly receive, upload, download, use, or re-use any material that does not comply with the these Terms; (g) to transmit, or procure the sending of, any advertising or promotional material, including any "junk mail," "chain letter," "spam," or any other similar solicitation; (h) to impersonate or attempt to impersonate any other person or entity; or (i) to engage in any other conduct that restricts or inhibits anyone's use or enjoyment of the Services, or which, as determined by us, may harm Nura Renüa, Shopify or users of the Services, or expose them to liability.
In addition, you agree not to: (a) upload or transmit viruses or any other type of malicious code that will or may be used in any way that will affect the functionality or operation of the Services; (b) reproduce, duplicate, copy, extract, sell, resell or exploit any portion of the Services; (c) collect or track the personal information of others; (d) spam, phish, pharm, or pretext the services; (e) use any robot, spider, scraping, data gathering and extraction tools, automatic devices or processes, AI tools (such as agentic AI) or automated or manual means to access the Services; or (f) interfere with, bypass, or circumvent the security or authorization features, robot exclusion headers, or other measures we employ to restrict access to the Services. We reserve the right to suspend, disable, or terminate your account at any time, without notice, if we determine that you have violated any part of these Terms.
SECTION 13A – BRAND MISREPRESENTATION & UNAUTHORIZED COMMERCIAL USE
Nura Renüa is committed to protecting the integrity, reputation, and identity of its brand. No individual or entity may falsely represent, imply, or suggest any affiliation, endorsement, sponsorship, partnership, authorization, or business relationship with Nura Renüa without our prior written consent.
Without limitation, you may not use our name, logos, branding, product photography, marketing materials, menus, website content, event concepts, or other proprietary materials in any manner that is likely to cause confusion regarding the origin, sponsorship, or affiliation of any product, service, or business.
You may not copy, imitate, reproduce, adapt, distribute, publish, sell, license, or commercially exploit our original branding, promotional materials, website content, photography, videos, menu designs, event concepts, or other creative works without our prior written permission.
Nothing in these Terms prohibits fair use, lawful commentary, news reporting, or other uses expressly permitted by applicable law. However, unauthorized commercial use, misleading representations, false advertising, unfair competition, impersonation, or conduct reasonably likely to confuse consumers regarding the identity or affiliation of Nura Renüa is strictly prohibited.
Nura Renüa reserves the right to pursue any remedies available under applicable federal, state, or local law to protect its intellectual property, brand identity, business reputation, and customers from unauthorized or misleading use of its original materials or business identity.
SECTION 14 - AGENTS
14.1 This section ("Agent Terms") applies if you use, allow, enable, or cause the deployment of an Agent to access, use, or interact with any Services. "Agent" means any software or service that takes autonomous or semi-autonomous action on behalf of, or at the instruction of, any person or entity and that can be executed on behalf of or using persons device, without direct supervision.
14.2 No Agent may access, use, or interact with Services unless, at all times, it identifies itself and operates in strict accordance with the requirements in section 14.4 below. In addition, no Agent may access, use, or interact with Services if we have requested that the Agent refrain from accessing, using, or interacting with any service.
14.3 We may limit, including by technical measures, whether and how any Agent accesses, uses, and interacts with Services.
14.4 Agents must: (i) in all HTTP/HTTPS requests, identify that the request is from an Agent and disclose the name of the Agent by including the following in the request's user agent string: "Agent/[agent name]"; (ii) not conceal or obfuscate that any access, use, or interactions are from an Agent, such as by (a) mimicking human behavior and interaction patterns, or (b) completing or circumventing CAPTCHAs or measures intended to distinguish computer use from humans, (iii) respond truthfully to any question or prompt seeking to determine if interactions are coming from a human or a computer, (iv) not circumvent or otherwise avoid any measure intended to block, limit, modify, or control whether and how Agents access, use, or interact with the Services.
SECTION 15 - TERMINATION
We may terminate this agreement or your access to the Services (or any part thereof) in our sole discretion at any time without notice, and you will remain liable for all amounts due up to and including the date of termination.
The following sections will continue to apply following any termination: Intellectual Property, Feedback, Termination, Disclaimer of Warranties, Limitation of Liability, Indemnification, Severability, Waiver; Entire Agreement, Assignment, Governing Law, Privacy Policy, and any other provisions that by their nature should survive termination.
SECTION 15A – RIGHT TO REFUSE SERVICE
